- The ToU will be on the website in the footer of every page that has OER on it.
- The ToU will be linked to from the disclaimer slide/page in all OER on this site.

Provide clear explanation of our use of particular objects
- ie: clearly marking in the material (eg: powerpoint slide) our determination for each image (openly licensed or public domain)
Use the Citation Policy document to support the ToU
- "Source:" is overloaded (means public domain due to term limit, public domain due to ineligible for protection, or fair use)
- We need to break this down.
- Wikimedia is an example of an organization explicityly stating whether something is used under no copyright/unprotectable reasons.
- eg see: http://commons.wikimedia.org/wiki/File:1-Et-CB11F12.png which is marked with the "PD-ineligible" tag which states "This file is ineligible for copyright and therefore in the public domain, because it consists entirely of information that is common property and contains no original authorship." (images tagged with that specific tag: http://commons.wikimedia.org/wiki/Category:PD_ineligible )
- In earlier discussion Jack did not want us to use the wikimedia model.
