[edit] Notes
[edit] Topic: Disclaimer/Terms of Use Discussion
Really 3 different topics:
- Disclaimer
- ToU
- "how to use" our material we make available
[edit] General
Keep them as separate documents Make the ToU not buried/no fine print/plain english Provide our educational materials for public consumption so they have a better idea of how we made our own decision.
- the 102(b) Casebook would likely be a part of this: http://open.umich.edu/wiki/Casebook
[edit] Disclaimer Specific
Continued discussion of this topic will occur at the Disclaimer Discussion page.
Main purpose: We're not responsible. This is not medical advice. Will change only slightly. Needs to still mention U.S. copyright law

[edit] ToU Specific
Continued discussion of this topic will occur at the ToU Discussion page.
Provide clear explanation of our use of particular objects
- ie: clearly marking in the material (eg: powerpoint slide) our determination for each image (openly licensed or public domain)
Use the Citation Policy document to support the ToU
- "Source:" is overloaded (means public domain due to term limit, public domain due to ineligible for protection, or fair use)
- We need to break this down.
- Wikimedia is an example of an organization explicityly stating whether something is used under no copyright/unprotectable reasons.
- eg see: http://commons.wikimedia.org/wiki/File:1-Et-CB11F12.png which is marked with the "PD-ineligible" tag which states "This file is ineligible for copyright and therefore in the public domain, because it consists entirely of information that is common property and contains no original authorship." (images tagged with that specific tag: http://commons.wikimedia.org/wiki/Category:PD_ineligible )
- In earlier discussion Jack did not want us to use the wikimedia model.
[edit] Explanation
What is the content you're viewing. Your right to use it is described in the terms of use. Might belong on the welcome to the site.
Draft
Note to users of this site: The operators of this site have attempted to tag posted content with notices indicating the source of the content, the name of the copyright holder (if known), and the scope of permitted use of the content. Some of the content is in the public domain (no copyright). The copyright in other content is owned by UM, its professors, or third parties who have authorized use of the content for purposes such as this global educational project.
[edit] Next Steps
- Susan will talk with Jack about the above for feedback
- Greg will find a contact at the Wikimedia Foundation to possibly have a discussion with regarding their process and how they came to the point they are now (ie: what we can learn from each other).
- Garin, Greg, and Bobby will speak at Susan's Advanced Copyright class this Friday
[edit] Next Meeting (draft agenda)
- We will review both the Disclaimer and ToS at the same time.
- Discuss merits/legal attractiveness of the wikimedia model
